Buffalo restaurants win restraining order against NY State, curfew lifted as case is pending

 


A group of 94 Buffalo, New York, area restaurants who filed a lawsuit against the state over a 10:00 pm curfew have won a restraining order on Friday lifting the curfew while the case is decided.


NY State has had an order in effect since Nov., 2020, which specifically requires bars and restaurants to close at 10:00 pm as part of its lockdown measures to curb coronavirus contagion. The measure has proven very unpopular especially with owners of these businesses, and also by people saying that the restrictions don't work.


Governor Andrew Cuomo admitted that there is only a 1.4 percent spread of COVID that's resulted from restaurants. This is compared to 74 percent transmission in personal homes.


According to local outlet WIVB4, Steve Cohen, an attorney working on behalf of the businesses, had this short statement.


"We are pleased Judge Timothy Walker lifted the 10:00 PM curfew for our clients (91 clubs, restaurants and bars) in Erie County and Monroe County."
